It is frustrating to see this, but suspect that it will turn out to
be an "oops" on someones part, and not an intent to infringe copyright
on the part of ASUS, Xandros or others involved.

I disagree with the title of the first article which appends "say
Linux stalwarts". Either a distribution of software infringes the
license agreement or it does not, and whether it is FLOSS or not is
largely irrelevant. Painting the whistle blower in some negative way is
never helpful.
